Description:

Completely updated and expanded Ontario Labour Relations Act: Quick Reference, 2012 Edition walks you through the Ontario Labour Relations Act, by defining the respective roles and duties of the workplace parties; describing the steps involved in the certification of a union; unfair labour practices; collective bargaining procedures; first agreement arbitration; sales of businesses; and how disputes under the agreement are to be resolved.

The 2012 edition contains the full text of the Ontario Labour Relations Act, as well as Regulations, Rules of Procedure, a List of Forms and Notices, and a helpful index to the full contents of the guide.

New in the 2012 edition:
  • A summary of recent changes to the government of Ontario and the management of the Ontario Labour Relations Board.
  • A review of a Supreme Court of Canada decision that narrows the scope of any constitutional right to bargain collectively under section 2(d) of the Charter of Rights and Freedoms.
  • Clarification that the Ontario Labour Relations Board's ability to declare an employer to be a "non-construction employer" for the purposes of the Labour Relations Act does not violate the freedom of association guarantee of section 2(d) of the Charter of Rights and Freedoms.
  • A review of recent jurisprudence expanding the type of injunctive relief employers may be able to obtain against illegal picketing and/or leafleting.
  • A summary of a recent decision of the Ontario Labour Relations Board with respect to the importance of particulars in unfair labour practice complaints.
The legislation cited in this edition is current to Ontario Gazette Vol. 144:45 (November 5, 2011).
