Federal Courts Practice 2010 continues the tradition of providing advice on a complete range of judicial review, trial and appellate proceedings. Part 1 is a chapter explaining the jurisdiction of the Federal Courts. Parts 2 and 3 set out the Federal Courts Act and the Federal Courts Rules, supplemented by explanatory notes, references to related provisions and secondary sources, and annotations of relevant cases.

New in the 2010 edition:
  • Amendments:
    • The rules governing summary judgment, rules 213 to 219, were amended adding a provision for summary trials and thus expand the range of circumstances in which summary judgment may be obtained.
  • The Chief Justice of the Federal Court of Appeal issued the following notices:
    • Instructions regarding rule 127(1) and rule 133 concerning service of a notice of appeal pending an amendment to the Federal Courts Rules.
  • The Chief Justice of the Federal Court issued notices to the profession:
    • The notice encourages the use of the case management rules in order to facilitate, where possible, the scheduling of trials within two years of the commencement of the proceeding.
    • Informs parties of proceedings in the Federal Court brought by prothonotaries against the federal government in respect of their compensation and benefits.
This edition contains annotations of relevant cases as of June 1, 2009.
